PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 14 February 1990, the US Army Transition Point, Fort Dix, NJ; Orders 047-015 discharged the applicant from the Regular Army, effective date: 16 February 1990, and the applicant accepted a direct assignment to the HHC 972 Engineer Battalion, Fort Benjamin Harrison, IN.

         b. On 16 February 1990, the applicant was discharged under the provisions of Chapter 4, AR 635-200, by reason of expiration term of service with a characterization of service of honorable. At the time of discharge, the applicant had completed 3 years, 10 months, and 27 days of active military service in the period under review and had a total of 6 years, 10 months, and 22 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200, in effect at the time, set forth the basic authority for separation of enlisted personnel. Chapter 4 of that regulation provided, in pertinent part, for the separation of individuals at ETS. An individual discharged by reason of ETS could receive a GD, UNCHAR or an HD depending on his/her record of service.

(1), (2), (3), and (4) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence shows that the applicant was honorably discharged under the provisions of Chapter 4, AR 635-200, upon conclusion of his term of active service and transferred to the Ready Reserve. On 23 February 1993 he was honorably discharged from the Ready Reserve. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
